Word To The Wise: Keep Your Demonstrations Safe Or Else You Will Pay (Literally)
A teen from Staten Island, New York has just received a settlement of $120,000 from his lawsuit against a kickboxing gym for an incident where his instructor had knocked him to the floor, badly breaking his arm in several places. The official reason for the settlement was improper and negligent supervision. The teens lawyer remarked “The instructor didn’t properly explain to the student what he was going to do, that’s the reason why liability was in our favor.” B.B.X Kickboxing is the school in question and Vladimir Khavchenko is the instructor. Khavchenko did comment that he is “careful” and that “I have no idea how he broke his arm.” The school is no longer open for business.
This serves as a great cautionary tale for all kickboxing instructors and owners alike out there: Be careful! You not only to take extra caution in making sure the execution of techniques are safe as well as students having the proper safety equipment but you also need to make sure to have all students sign the proper waivers before they train at your school. In the end, you will be the one who suffers if you don’t. Khavchenko was haphazard in both physical technique as well as not having the proper paperwork filed before the teen in question stepped on his mats and now his school is permanently closed.
